Tow Truck Driver Killed in Hit and Run

A tow truck driver was killed by a hit and run driver on Highway 50 on 22 February.

According to California Highway Patrol the accident happened near Jefferson Boulevard in West Sacramento. Octavio Portugal received a call from 29 year old Michael Bower on Monday night saying that the tow truck he was driving had overheated on westbound Highway 50 near Jefferson Boulevard. Portugal went out to find him and fixed the truck. He then left, assuming Bower was behind him, but when he realized he wasn’t he returned to where he had left the truck.

When he arrived the CHP officers were there and they had discovered Bower’s body which had apparently been hit by a big rig that swerved onto the shoulder but never stopped.

The police are now looking for the driver of the rig, but they say the driver may not have known he or she struck the tow truck driver.

Pedestrian Accident Locations

We tend to think of a pedestrian accident as something that happens when crossing the street, but pedestrian accidents can happen anywhere that vehicles and people who are not inside vehicles may encounter each other. Examples of setting where pedestrian accidents occur include:

  • Intersections
  • Crosswalks
  • Alleys
  • Sidewalks
  • Front yards
  • Parking lots
  • Parking structures
  • Shoulder of the road
  • Bike paths
  • School zones
  • Bus stops
  • Driveways
  • Freeways, including on-ramps and exit ramps
  • Overpasses and bridges
  • Railroad crossings
  • Loading and unloading zones
  • Warehouses

Although driver negligence is most often the cause of pedestrian accidents, the location of a pedestrian accident can play a role in who can be held liable.

If a malfunctioning traffic signal, or another roadway defect was involved, you may have a case against the government entity responsible for the design, construction and/or maintenance of the roadway. In pedestrian accidents that are the result of factors such as poor parking lot design or inadequate lighting in parking structures may fall under premises liability.
